Mobile Application Privacy Policy

 

JSC BALTIC INTERNATIONAL BANK (We) are committed to protecting and respecting your privacy, complying with applicable data protection laws and thus ensuring the protection and confidentiality of your personal data.

SCOPE OF THE POLICY

This policy sets out the basis on which any personal data collected from you, or that you provide using our services will be processed by us.

This policy applies to your use of:

  • Any mobile application software (App) available on different App stores specified by us or web applications hosted on our servers (App Site), once you have downloaded or streamed a copy of the App onto your mobile telephone or handheld device (Device).
  • Any of our services accessible through the App that are available on the App Site, unless We state that a separate privacy policy applies to a particular service and/or that a particular service provided by us is regulated by the provisions of any internal agreement entered into by and between you and us, are regulated by that policy and that privacy policy only applies.

Prior to using our services accessible through the App please carefully read these terms and conditions of use of the App and App Site.

By submitting your data, you agree to data transfer, storing and/or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy.

We maintain strict security standards and procedures with a view to preventing unauthorised access to your data by anyone, including our staff. We use leading technologies such as (but not limited to) data encryption, firewalls and server authentication to protect the security of your data. We are required to observe our privacy standards and to audit personal data for compliance purposes.

In case if you do not agree with this please do not visit and do not use the App Site, as well as do not use the services offered or information provided in App.

INFORMATION WE MAY COLLECT FROM YOU

We may collect and process the following data about you:

Information you give us (Submitted Information): You may give us information about you by filling in forms on the App Site. This includes information you provide when you register to use the App Site, download or register an App, subscribe to any of our services, search for an App or service, share data via an App's social media functions and/or any other activities commonly carried out in connection with an App. The information you give us may include your name, address, e-mail address and phone number, the Device's phone number, age, username, password and other identification and/or registration information, financial and credit card information and etc.

Information We collect about you and your Device. Each time you visit App Site or use App We may automatically collect the following information:

  • technical information, including type of Device you use, an unique Device identifier (for example, Device's IMEI number, the MAC address of the Device's wireless network interface, or the mobile phone number used by the Device), mobile network information, your mobile operating system, the type of mobile browser you use, time zone setting and etc. (Device Information);
  • information stored on your Device, including contact information, login information, other digital content, check ins and etc. (Content Information);
  • details of your use of App, including, but not limited to, traffic data, location data, weblogs and other communication data, whether this is required for our own billing purposes or otherwise and the resources that you access (Log Information).

Location information: We may also use GPS technology or other available technology to determine your current location. Some of our location-enabled services may require your personal data for the feature to work. If you wish to use the particular feature, you will be asked to consent to your data being used for this purpose.

Information We receive from other sources (Third Party Information): We are working closely with third parties (including, for example, business partners, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers, search information providers, credit reference agencies) and may receive information about you from them.

We may also ask you for information when you report a problem with the App or App Site.

If you contact us We may keep a record of that correspondence. We may also ask you to complete surveys that We use for research purposes, although you do not have to respond to them.

COOKIES

We use cookies to distinguish you from other users of App, App Site. This helps us to provide you with a good experience when you use the App. Using the possibilities of your browser, you can reject the use of cookies. We warn you that by rejecting use of cookies you will not be able to use all of the possibilities offered by App, App Site and our website as well.

USE OF PERSONAL DATA

We use information held about you in the following ways:

  • To ensure offering, providing and managing of services rendered to you;
  • To provide and maintain clients records;
  • To provide you with information, services or products (if any) that you request from us or which We feel may interest you;
  • To carry out our obligations arising from any agreements entered into by and between you and us;
  • To ensure that content from App Site is presented in the most effective manner for you and for your Device;
  • To allow you to participate in any interactive features of App Site, when you choose to do so;
  • To notify you about changes to App Site;
  • To notify you about changes to this privacy policy.

We may also use your data to provide you with information about our services and goods (if any) which may be of interest to you and We may contact you about these by post, telephone, email or text message.

We may associate any category of information with any other category of information and will treat the combined information as personal data in accordance with this policy for as long as it is combined.

We do not disclose information about identifiable individuals to our advertisers, but We may provide them with anonymous aggregate information about our users. We may make use of the personal data We have collected from you to enable us to comply with our advertisers' wishes by displaying their advertisement to that target audience.

DISCLOSURE AND OBTAINIG OF YOUR PERSONAL DATA

We may disclose and obtain your personal data:

  • If We are under a duty to disclose your data to and if We are entitled to obtain your data from the Bank of Latvia’s Credit Registry or similar state authority and/or registry (including, but not limited to, any publicly available registry or data base, if any) to the extent permitted and prescribed by the particular state authority and/or registry rules, terms and conditions, and applicable laws.
  • If We are under a duty to disclose your data to third parties in cases of your failure to duly perform your obligations under any agreement entered into with us. Also, We may disclose your data to operators collecting personal data, to the extent as may be necessary to such operators to perform their functions under applicable laws.
  • If We are under a duty to disclose your data to and if We are entitled to obtain your data from third parties whom We have contractually engaged to perform certain functions or to provide services in connection with the services rendered and activities carried out by us. In these cases We disclose to or obtain your data from the third parties in such total volume as may be necessary to ensure that our particular service is provided.
  • In the event that We sell or buy any business or assets, in which case We may disclose your data to the prospective seller or buyer of such business or assets and/or if We or substantially all of our assets are acquired by a third party, in which case personal data held by us about our customers will be one of the transferred assets.
  • If We are under a duty to disclose or share your personal data in order to comply with any legal or regulatory obligation or request.

In addition to the aforesaid and as defined in applicable laws regulating data use and disclosure of your personal data We may disclose some or all of the data We collect from you when you download or use App and/or use services provided by us to any member of our group, which means our subsidiaries our ultimate holding company and its subsidiaries (Group member) (if any).

WHERE WE STORE YOUR PERSONAL DATA

All information you provide to us is stored on our secure servers. Any payment transactions carried out by us or our chosen third-party provider of payment processing services will be encrypted using Secured Sockets Layer technology or alternative encryption technology.

Where We have given you (or where you have chosen) a password that enables you to access certain parts of App Site, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

Use of any means of your identification and verification of authenticity issued by us shall be treated by the provisions of particular agreements entered into by and between you and us as well as governed by our internal guidelines and instructions duly notified to you.

However, the transmission of any data and information via the internet is not completely secure. Although We will do our best to protect your personal data, We cannot guarantee the security of your data transmitted to our websites and servers; any transmission is at your own risk. Once We have received your information, We will use strict procedures and security features to prevent unauthorised access.

We may collect and store personal data on your Device using application data caches and browser web storage (including HTML 5) or alternative mechanisms and other technology.

 

DATA PROTECTION

Please note that pursuant to any applicable data protection laws in each jurisdiction (including, without limitation, Personal Data Protection Act of the Republic of Latvia,  European Data Protection Directive 95/46/EK and any national laws implementing the aforesaid directive), our internal guidelines and rules (including, without limitation, our General Terms and Conditions for Transactions) we are obliged to inform you that any personal data may be disclosed, processed and transferred by us and other Group member (if any) on a worldwide basis for the purposes of providing services to the customers whom you represent and/or for servicing our relationship with them or you as well as in other cases already stipulated in this policy.

We will not disclose or transfer your personal data to third parties for the purposes of marketing. However, personal data may be disclosed or transferred to agents or third parties authorised to act on our behalf or Group members (if any) or to third parties for the purposes of providing the designated services.

If you are in the European Economic Area (“EEA”), please note that We may also in connection with the above purposes transfer your personal data to the entities authorised above in countries outside of the EEA, which may not provide the same level of protection for personal data as within the EEA. However, all your data wherever it is held by us will be afforded a high level of protection against any unauthorised or accidental disclosure, access or deletion.

Please note, that App Site may, from time to time, contain links to and from the websites of App and our partner networks, advertisers and affiliates (including, but not limited to, websites on which App or our services are advertised). If you follow a link to any of these websites, please note that these websites and any services that may be accessible through them have their own privacy policies and that We do not bear any responsibility or liability for these policies or for any personal data that may be collected through these websites or services, including, but not limited to, contact and location data. Please check these policies before you submit any personal data to these websites or use these services.

YOUR RIGHTS

You have the right to ask us not to process your personal data for marketing purposes. We will usually inform you (before collecting your data) if We intend to use your data for such purposes or if We intend to disclose your information to any third party for such purposes.

You can exercise your right to prevent such processing by contacting us.

You have the right to access data held about you. Your right of access can be exercised in accordance with our internal rules. You can exercise the right at any time by contacting us.

CHANGES TO PRIVACY POLICY

Any changes We may make to our privacy policy in the future will be posted on our website www.bib.eu and, where appropriate, notified to you.
